Die Bundesanstalt für Finanzdienstleistungsaufsicht (BaFin) hat am 17. August 2022 gegenüber der Volksbank Spree-Neiße eG zusätzliche Eigenmittelanforderungen angeordnet.
Grund für die Maßnahme ist ein Verstoß gegen die Anforderungen an eine ordnungsgemäße Geschäftsorganisation im Sinne des § 25a Absatz 1 Kreditwesengesetz (KWG). Bei einer Sonderprüfung hatte sich gezeigt, dass die Ordnungsmäßigkeit der Geschäftsorganisation gemäß § 25a Ab-satz 1 KWG derzeit nur mit Einschränkungen gegeben ist.
Rechtsgrundlage für die Anordnung ist § 10 Absatz 3 Satz 1 in Verbindung mit Satz 2 Nr. 2 KWG. Der Bescheid ist seit dem 23. September 2022 bestandskräftig.
Die Veröffentlichung erfolgt aufgrund von § 60b des KWG.
