Die BaFin hat bei einem ihrer Aufsicht unterstehenden Institut am 12. November 2021 einen Sonderbeauftragten mit Geschäftsleiterbefugnis gemäß § 45c Absatz 1 Satz 1 in Verbindung mit Absatz 2 Nummer 1 Kreditwesengesetz (KWG) bestellt. Dem Sonderbeauftragten wurden die sämtlichen Aufgaben und Befugnisse eines der Geschäftsleiter übertragen.
Grund hierfür waren insbesondere Verstöße gegen die Anforderungen an eine ordnungsgemäße Geschäftsorganisation im Sinne des § 25a Absatz 1 KWG.
Der Bescheid ist bestandskräftig.
