Die Bundesanstalt für Finanzdienstleistungsaufsicht (BaFin) hat am 12. September 2022 gegenüber der FIL Fondsbank GmbH angeordnet, die ordnungsgemäße Geschäftsorganisation nach § 25a Absatz 2 Satz 2 Kreditwesengesetz (KWG) sicherzustellen.
Grund für die Maßnahme ist ein Verstoß gegen die Anforderungen an eine ordnungsgemäße Geschäftsorganisation im Sinne des § 25a Absatz 1 KWG. Eine Sonderprüfung hatte ergeben, dass die Ordnungsmäßigkeit der Geschäftsorganisation im Sinne des § 25a Absatz 1 KWG in den geprüften Bereichen nicht gegeben war.
Die Anordnung ergeht auf Grundlage des § 25a Absatz 2 Satz 2 KWG. Die Veröffentlichung erfolgt aufgrund des § 60b Absatz 1 KWG.
Der Bescheid ist bestandskräftig.
