Die Bundesanstalt für Finanzdienstleistungsaufsicht (BaFin) hat am 27. September 2022 gegenüber der Coinbase Germany GmbH die Sicherstellung einer ordnungsgemäßen Geschäftsorganisation nach § 25a Absatz 2 Satz 2 des Kreditwesengesetzes (KWG) angeordnet.
Grund für die Maßnahme sind Verstöße gegen die Anforderungen an eine ordnungsgemäße Geschäftsorganisation im Sinne des § 25a Absatz 1 und des § 25b Absatz 1 Satz 2 KWG.
Bei einer Jahresabschlussprüfung wurden bei dem Institut organisatorische Mängel festgestellt. Die Ordnungsmäßigkeit der Geschäftsorganisation war nicht in allen geprüften Bereichen gegeben.
Die Anordnung ergeht auf Grundlage des § 25a Absatz 2 Satz 2 KWG. Die Veröffentlichung erfolgt aufgrund des § 60b Absatz 1 KWG.
Die Anordnung ist seit dem 27. Oktober 2022 bestandskräftig.
