Die Bundesanstalt für Finanzdienstleistungsaufsicht (BaFin) hat am 18. August 2022 gegenüber der Deutsche Bausparkasse Badenia AG zusätzliche Eigenmittelanforderungen angeordnet.
Grund für diese Maßnahme ist ein Verstoß gegen die Anforderungen an eine ordnungsgemäße Geschäftsorganisation im Sinne des § 25a Absatz 1 Kreditwesengesetz (KWG). Eine Sonderprüfung hatte ergeben, dass die Ordnungsmäßigkeit der Geschäftsorganisation im Sinne des § 25a Absatz 1 KWG in geprüften Bereichen derzeit nicht gegeben ist.
Rechtsgrundlage für die Anordnung ist § 10 Abs. 3 Satz 1 in Verbindung mit Satz 2 Nr. 2 KWG
Der Bescheid ist seit dem 22. September 2022 bestandskräftig.
Die Veröffentlichung erfolgt aufgrund von § 60b des Kreditwesengesetzes.
