Question

Prior to 1 January 2023 is it possible to prepare a KID based on the new requirements in Commission Delegated Regulation (EU) 2021/2268, for example for a product launched between September and December 2022 or a product with a subscription period that runs from 2022 into 2023?

Answer

The requirements in Commission Delegated Regulation (EU) 2021/2268 do not apply until 1 January 2023. Therefore, all KIDs published prior to that point need to comply with the existing requirements in Commission Delegated Regulation (EU) 2017/653.
