Question
Can a CSP use several trading names?
Answer
(Published as Crowdfunding Q&A 6.2) Yes. A CSP can operate using different trading names. Pursuant to point (a) of Article 12(2), of the ECSPR these trading names shall be communicated to the competent authority. The register kept by ESMA pursuant to Article 14 of the ECSPR shall contain the commercial name or names of the authorised CSP. Pursuant to Article 3(2) of the ECSPR, a CSP shall, at all times, act honestly, fairly and professionally with its clients. Consequently, a CSP shall ensure that its use of different trading names should not have the potential to create confusion for its investors and especially its non-sophisticated investors (and prospective non-sophisticated investors).
