Question

Can the entity which is designated in accordance with Article 7(2) of the Securitisation Regulation assume the sole responsibility for the information which it makes available in accordance with Article 7(2) of the Securitisation Regulation?

Answer

[ESMA 33-128-563 Securitisation Q&A, Q&A 5.1.7.a] No. As set out in Article 7(1) of the Securitisation Regulation, the originator, sponsor and SSPE of a securitisation remain jointly responsible for the information made available in accordance with Article 7(2). For STS non-ABCP securitisations, as set out in Article 22(5) of the Securitisation Regulation, only the originator and sponsor of the securitisation remain jointly responsible.
