Question
Are you able to provide a legal definition or additional context for the interpretation of "ICT Service" and "ICT Service Provider"?
Background
In the DORA Dry Run FAQ document it is mentioned there will be a Q&A on a legal interpretation - when will this be? Clarity in this area would be very welcomed as there is confusion on the scope of DORA and whether all software companies (including those who do not provide any service to financial services entities in the context of their regulated activities) need to be registered.
Answer
The question has been rejected because the matter it refers to has been answered in Q&A DORA030, which provides guidance regarding the difference between ICT service and financial service.
This Q&A is published by European Insurance and Occupational Pensions Authority and is non-binding. It does not constitute legal advice. Updated weekly from official ESA sources.
