Question
Optionality of the newly introduced thresholds in the taxonomy 2.8.0 and in particular to the questions S.18 / S.19 / S.20 / S.21: EIOPA indicates in some of its responses to the industry comments submitted during the public consultation (see cell G115, G172, G251 and G555 of the resolution table) that the application of the thresholds are not compulsory. In particular EIOPA says: “Furthermore, it should be noted that the application of the threshold is not mandatory, ie. insurer may or may not use it.” However the legal text reads “This template shall be reported for each material non-life line of Business for direct business, as defined in Annex I to Delegated Regulation (EU) 2015/35, representing a coverage of 90% of the non-life technical provisions » The text leads to a bit of confusion as it does not add the term “at least” (i.e representing a coverage of at least 90% of..). Companies currently reporting a 100% of their non-life technical provisions are wondering whether they need to adapt their systems to report 90% and not 100%. Can EIOPA provide a clarification?

EIOPA confirms that companies that currently report a 100% of their non-life technical provisions in S.18/S.19/S.20/S.21 templates and would like to not benefit from the newly introduced thresholds for these templates in the taxonomy 2.8.0 can still continue to report 100% of their non-life technical provisions without adapting their systems to report 90% of them.
