Question

La parte de la exposición que supere el valor hipotecario dice que le será asignada la ponderación de riesgo aplicable a las exposiciones no garantizadas de la contraparte implicada. Si la contraparte es minorista, cómo puede ser que la parte de la exposición que supere el valor hipotecario vaya ponderada al 75% y la parte que va entre el 80% y el 100% del valor hipotecario vaya ponderada al 100%? ENGLISH TRANSLATION: In Article 124 of Regulation (EU) No 575/2013 (CRR) it says that the part of the exposure which exceeds the mortgage value shall be assigned the risk weight applicable to the unsecured exposures of the counterparty involved. If the counterparty is retail, can you explain how the part of the exposure which exceeds the mortgage value shall have a weight of 75% and the part which goes from 80% through 100% of the mortgage value shall have a weight of 100%?

En artículo 124 apartado 2 párrafo 3 pone ponderación entre 35 y 150 pero no dice en ningún sitio cuándo es 150. ENGLISH TRANSLATION: In Article 124(2)(3) the weight is between 35% and 150% but it does not say when it is 150%.

Answer

La parte de la exposición plenamente garantizada por la hipoteca sobre bienes inmuebles residenciales, tal y como se define en el artículo 124, apartado 1, segundo párrafo, del Reglamento (UE) nº 575/2013 (RRC), pero no garantizada plena e íntegramente por la hipoteca sobre bienes inmuebles residenciales en virtud del artículo 125 del RRC, se tratará con arreglo al artículo 124, apartado 1, primer párrafo, del RRC. Se debería asignar una ponderación de riesgo del 100 % a esta parte de la exposición, salvo que se haya clasificado parte de la exposición en otra categoría de exposición, en cuyo caso se aplica la ponderación de riesgo de esa otra categoría de exposición. Además, se debería asignar a la parte de la exposición que supere el valor hipotecario de los bienes inmuebles residenciales la ponderación de riesgo aplicable a las exposiciones no garantizadas de la contraparte implicada. Cuando se cumplan todas las condiciones dispuestas en el artículo 123 del RRC, podrá asignarse una ponderación de riesgo del 75 %   tanto a la parte de la exposición "plenamente garantizada" (con arreglo al artículo 124, apartado 1 del RRC), pero no " garantizadas plena e íntegramente " por la hipoteca sobre bienes inmuebles de uso residencial, como a la parte de la exposición no garantizada (en virtud del artículo 125) por la hipoteca sobre bienes inmuebles de uso residencial, se les podrá asignar la RW pertinente aplicable en virtud del artículo 123. Este tratamiento no se aplicaría a las exposiciones en situación de impago puesto que en este caso la ponderación por riesgo se calcula según el artículo 127 del RRC. De acuerdo el artículo 124, apartado 2, la ABE publicará las ponderaciones de riesgo más elevadas con arreglo el artículo 124, apartados 2 y 3, establecidas por la autoridad es competente s o designada. ENGLISH TRANSLATION:  The part of the exposure fully secured by the mortgage on residential immovable property, as defined in the second subparagraph of Article 124(1) of Regulation (EU) No 575/2013 (CRR), but not fully and completely secured by the mortgage on residential immovable property according to Article 125 is treated according to the first paragraph of Article 124(1) of the CRR. This part of the exposure should be assigned a risk weight of 100% unless any part of the exposure is assigned to another exposure class in which case the risk weight of that other exposure class applies. Further, the part of the exposure that exceeds the mortgage value of the residential immovable property should be assigned the risk weight applicable to the unsecured exposures of the counterparty involved. Where all the conditions provided for in Article 123 of the CRR are met, both the part of the exposure "fully secured" (under Article 124(1)) but not "fully and completely secured" by the mortgage on residential immovable property and the part of the exposure not secured (under Article 125) by the mortgage on residential immovable property can be assigned  a risk weight of 75% the relevant RW applicable under Article 123 . This treatment would not be applicable to exposures in default because these are risk weighted according to Article 127 of the CRR. The higher risk weights according to Articles 124(2) and (3) of the CRR set by the competent  or designated  authorit y ies  are published by the EBA according to Article 124(2).
